The real question there is wether common carrier rules apply. If you
aren't controlling people's access _through_ your network, are you
responsible for what they do _using_ your network?

Carriers aren't responsible for the content that they carry through
their networks. If they were responsible, you would see a much more
thorough policing of botnets and free speech in general.

As a residential customer, however, you're probably not contractually
allowed to do this with your provider. While a counter argument to your
personal status as a common carrier (which wouldn't help in a court
case), that agreement is technically with your provider, which I would
think would merely open you up for breech of contract with your provider.

Then again, I'm Only Really Glad I'm Not A Lawyer (ORIGINAL?) ;)
