I read one interview or blog where a senior Novell tech said they had been
trying to get some agreements in for a long time with MS. In frustration they
accepted the latest "yes, if you agree to this too, we'll sign" from MS.
Apparently there was a long string of back and forth where MS wanted more
than Novell wanted to give. (I'm pretty sure it was a blog I stumbled on to.)

Since the full agreement is not being made public we can't say for sure one
way or the other. But that interview shows a clear indication that it was not
really what Novell had been looking for. They just gave in in the end.
